These Terms & Conditions (“Terms”) govern your access to and use of the JourneyM8 mobile applications, the website at journeym8.com, and related services (together, the “Service”), provided by JourneyM8 Ltd (“JourneyM8”, “we”, “us”, or “our”), a company registered in England and Wales. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

JourneyM8 is intended for adults of legal drinking age in their country or region of residence (for example, 18 in the United Kingdom and 21 in the United States). By using the Service, you confirm that you meet this requirement. The Service is not intended for anyone under that age.

2. The Service

JourneyM8 is a whisky companion and education service that helps you record and understand your whisky collection, tasting experiences, learning, and discoveries. JourneyM8 provides information and tools for personal interest and education; it does not sell, supply, or deliver alcohol.

3. Your account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Please keep your sign-in details secure and notify us promptly of any unauthorised use. You agree to provide accurate information and to keep it up to date.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
• upload content that is unlawful, infringing, harmful, or that you do not have the right to share;
• misuse or interfere with other users’ use of the Service.

5. Your content

You retain ownership of the content you create or upload (such as your collection data, tasting notes, and photos) (“Your Content”). You grant us a limited, non-exclusive licence to host, store, process, and display Your Content solely as necessary to operate and provide the Service to you. You are responsible for Your Content and confirm you have the rights to it.

6. Memberships and purchases

The Service may offer paid options, including Founding Member contributions on our website and in-app purchases.

• Founding Members are processed through Stripe. A Founding Member contribution is a one-time payment to support JourneyM8 and to receive the benefits described for the relevant tier; it is a form of participation and is not an investment or a donation in the charitable sense.
• In-app purchases are processed by Apple and are also subject to Apple’s terms. Pricing and availability may change.
• Except where required by law or by the applicable store’s policies, payments are non-refundable. For purchases made through Apple, refunds are handled in accordance with Apple’s policies.

7. Intellectual property

The Service, including its software, design, text, graphics, and other content we provide (excluding Your Content and third-party materials), is owned by or licensed to JourneyM8 and is protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the Service for your own non-commercial use, subject to these Terms. You may not copy, redistribute, or create derivative works from our content without our permission.

8. Third-party services

The Service relies on, and may link to, third-party services (such as Apple, Stripe, Cloudflare, and others). Your use of those services may be subject to their own terms and privacy practices, and we are not responsible for them. The app is also subject to the standard end-user licence terms of the app store from which you download it (including Apple’s Licensed Application End User License Agreement, where applicable).

9. Responsible enjoyment & no professional advice

JourneyM8 promotes the thoughtful, responsible enjoyment of whisky by those of legal drinking age. Content within the Service is provided for general information and education only and is not medical, legal, financial, or professional advice. Please drink responsibly and know your limits.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of liability

To the fullest extent permitted by law, JourneyM8 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law (including liability for death or personal injury caused by negligence, or for fraud).

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, except where mandatory local consumer-protection laws of your country of residence provide otherwise.
